The website nirshamim.com serves as a platform for the advertising and sales promotion for the field of education, via the Internet. From the commercial aspect, the site serves as a technological platform for the meeting of aspirations between companies and institutes of education that are interested in proposing sales of products, courses or services that they manufacture and/ or market, and between the parties who are interested in purchasing these; and for those who are interested it also offers information, free of charge, consultation, invitations to open days or informative gatherings.
You are invited to take part in the site in subordination to your agreeing to the conditions of advertising and terms of use. Any use of the Nirshamim site - is permitted in accordance with the term of use that are detailed in the following. Completion of the process of registration for the site's services, signing the advertisement order page on the site, or entering as an institute/ advertiser by entering a password or username is interpreted as your granting approval and agreement that you have read the following and that you agree to its contents and that you are using the site in subordination to the above. You are of course entitled not to complete the process of registration to the site and in this case you will not be able to use the site or any part of it in accordance with the nature and the content of the matter.
General:
In any event of a conflict between that which is stated in these regulations and that which appears on the website in relation to a specific product or service, the instructions of these terms and conditions will be the obligating except if explicitly stated otherwise.
The conditions of use have been written in the masculine form strictly for the sake of comfort, we apologize. Any expression put forth in singular and/ or in the masculine form is to be viewed as applying and obligating in the feminine and plural forms, according to the matter.
The trademarks and/ or advertisements appearing on the website are the property of the company, or in the event that they have been published on behalf of the advertisers or institutes, then they are the sole property of these. They may not be used without their consent in writing and in advance. The order in which the offers, institutes of education or advertisements appear does not indicate their quality or their importance.
The site is intended for the use of users who are Israeli citizens and residents, aged 18 or over, who are legally qualified and who are not prevented by any legal reason from making an obligating, contractual contact. The site is designated for the use of institutes of education and learning that are interested in advertising and promoting the sales of services, products or courses on their behalf, and for users and websurfers who are interested in these products, in institutes of learning, advertisers or the information and services offered on the site.
The essence of the website:
The Nirshamim website does not organize and is not responsible for the services offered within it, it also does not sell and/ or supply the products or services offered on the site. All responsibility for the products and services purchased on the site through us or our advertising, as well as the accompanying information and advice given on the site and in the advertisements, falls solely on the companies and institutes who have proposed or offered these. The information on the website does not constitute professional advice, or recommendation or encouragement to purchase services on our behalf or on behalf of the advertisers. The full and sole responsibility for your actions and their results, directly or indirectly that may be incurred by you or a third party, is your own, if you have decided to act upon the basis of this information.
Any transaction that may be carried out following an advertisement, or offer on the Nirshamim website, or information that appears in another way on the site, will be concluded directly between you and the institute or advertiser. We are not a side in this transaction, and we will not assume any responsibility for goods and services that are offered to you or will be purchased through us or our advertisements. We do not assume any responsibility for any damages, discomfort, loss, grief or the results of which, direct or indirect, may be incurred by you, your property or any third party due to the use of these contents or products, services, courses or training advertised on the site.
In accordance with the Privacy Policy, the site operators will be entitled, from time to time, to send electronic mail messages containing advertisements and commercial material and such. The site operators are not responsible for the content of these kinds of messages or the goods and services that have been supplied through these by a third party to the user and/ or any third party, and the user agrees that the site operators will have no obligation or responsibility in relation to this issue. The user undertakes to enter only correct and accurate data while registering or using the site. A user who enters incorrect or inaccurate data or, all the more so, false information, is liable to be sued through civil or criminal procedures, according to the matter, for any damages caused to the company, the institute of learning, or the advertiser as a result of this and in any case this act constitutes a civil and criminal offense.
The company is entitled to publish the identifying details of anyone offering a service or product together with the details of the offer - in parallel with the selling or following it, in addition, only minimal identifying details (Name and city of residence) will be given, as well as the details of the offer or benefit. Following the win, the company is entitled to publish the essence of the offering party's details, the amount of the win, or the details of the benefit if it so desires and this right will be maintained at all times and in general for the sake of advertising. You hereby agree to publish these details on Nirshamim's site in such a way that they will be revealed to all Internet users.
About the services and products offered on the site:
Initiation of contact with the institute of learning: consultation session, bulletins and registration packages: Setting up a consultation session, receipt of a bulletin or any other proposal advertised on the site by the institute of learning the purpose of which is to offer information or to coordinate a consultation session without any obligation or fees (unless specifically indicated). Upon your submitting a request for information or a meeting, your details will be passed on to the institute of learning you were interested in for coordinating a meeting or sending the required information by mail or making contact, in accordance to the nature and context of the above.
Nirshamim's Exclusives
The Nirshamim Exclusives cards award benefits given on behalf of and with the full guarantee of institutes or other advertisers on the site. These benefit cards can be a gift or a benefit to be used without any conditions (except for single use by username or end of supply) or it can be a gift or benefit conditioned with registration to studies at an institute, or attending a meeting or an Open Day, or any other condition set by the institute or advertiser. Upon request to realize the benefit, or upon request for further information regarding the benefit, your details will be passed on to the institute offering the benefit in order to send additional or required information by mail or to realize the benefit, in accordance to the nature and context of the above.
Use of the Nirshamim platform by the advertiser:
The service offered on Nirshamim's platform is As Is and the site operators will not assume any responsibility for its adaptation to the user's needs and/ or purposes. The user hereby declares, that he is aware that the site operators are not responsible for any use he makes, directly or indirectly, of the services and their conditions and that he is fully and solely responsible for any use he makes of the service, and for all the products and services offered on the site on behalf of the institute.
The operators of the site are entitled to discontinue your use of the site in the event that in their opinion the conditions of this agreement have not been fulfilled. And you will compensate the site operators and/ or those connected to them for any suit and/ or demand and/ or damages and/ or loss and this includes lawyer's fees and court expenses - that will be incurred as a result of not fulfilling the directives of this regulation and/ or violating any lawful regulations or rights of any third parties. The site operators may change the nature of services and/ or discontinue the site's services at any time, whether or not a notice has been given in advance, and they will have no obligations towards any of the advertisers and/ or third parties regarding the discontinuation or change in the abovementioned services.
The site operators do not have any commitments that the service will not be interrupted and/ or will not take place on time, at all times, securely and without any mistakes or disturbances and that it is immune to illegal access to the company's computers. The site operators are not responsible for any damages,
direct or indirect, grief or otherwise that may be incurred by you or your property due to the above circumstances.
The site operators are entitled to shut down the site and/ or from time to time to change the structure of the site, its appearance, availability of services and contents offered within it and this is without the need of advanced notice. You will have no complaints, objections or demands towards the company regarding this issue. Furthermore, the site operators have no obligations regarding the results that will be obtained from the use of the site or regarding the precision and credibility of the information that is obtained through the site.
Use of the limited areas on the site (those requiring a username and a password)
The Nirshamim website includes departmentalized areas intended for the advertisers or other users for which the access to these is limited to those who have a username and a password (for users - the username and password they entered upon initial entry, for an institute of learning or advertiser - the username that was defined upon initial use).
The user will be responsible for maintaining the secrecy of his password on the site. He will also be responsible for any operation or use that is performed on his account, whether these were done with his knowledge and authorization, or not. The institute of study is obligated to immediately report to the site operators any unauthorized use of its account so that they may take the necessary steps in order to terminate this above-mentioned use.
The site operators invest reasonable efforts under the circumstances in order to protect the user's particulars and his privacy, in accordance with the privacy policy. Furthermore, due to the nature of the network, it is not possible to ensure total protection of these details. Therefore, the user releases the site operators from all responsibility and any harm or damages, direct or indirect, financial or other, that the user may incur as a result of these details being exposed, without any connection to the reason of their being exposed.
Updating and advertising information on the site:
When you advertise or pass on information for advertising on the site, or authorize an advertisement on the site in your name, directly by yourself or through a third party, you in fact are authorizing its delivery and giving authorization for publishing because you are owner of all of its rights, because you are entitled to publish it and in publishing this information, partially or in whole, there is no violation of rights of any third party whatsoever. The site operators are entitled to limit or to cancel the ability for direct updating of the institute's card and the courses that are associated to each institute according to their sole discretion and to only enable indirect updating via the site operators. Also in the case in which the possibility of updating the institute's card or courses directly has been given to the institute, the site operators reserve the right to delete, edit and omit contents that oppose the site's procedures of use, and this is in accordance with their sole discretion. The site operators' decision to do so is not to be viewed as taking responsibility for the contents that appear on the site that were not placed there by them and/ or placed by the institutes.
Every advertiser or institute of learning can control and update the information appearing on his card. The responsibility for these contents fall on the advertiser and it is his sole responsibility to bear all the damages and to compensate the site operators or a third party for any suit that may be filed on the basis of these contents.
The user is obligated to refrain from uploading, storing, or distributing via the site any contents that contain one or more of the following: -Illegal contents and/ or contents that were intended for the execution of illegal actions.

Contents that impair the activity of the site and/ or the other users of the site and/ or other advertisers or institutes of learning.

Contents of a slanderous, harassing, inciting nature or personal insult, etc.

Contents containing viruses and software that may cause damages.

Contents of an advertising or commercial nature that were not allowed for advertising in accordance with the advertising agreement which obligates the institute.

Contents that violate the copyrights and/ or infringe on the copyrights.

Contents that oppose the law forbidding slander and/ or the protection of privacy.

Pictures or images or graphs that they do not hold the copyrights for their use.
Limitation of responsibility
The site operators, including the managers, the employees, or anyone on their behalf, will not be responsible for any damages, direct or indirect, that are brought upon the institute of learning and/ or the user of the site and/ or any third party because of using the site's infrastructure and/ or information and/ or its content and/ or because of termination of service including that due to errors and/ or defects in transfer of information whether these were caused intentionally by any third party or whether these were caused by any kind of fault.
The company is entitled to change these conditions of use from time to time without giving any notice in advance. The company will publish the new conditions and the commencement of their validity will be upon their publication. The sole and exclusive location of jurisdiction for any matter and argument regarding the services on the site will be the authorized court of law in Tel Aviv which will discuss the matter in accordance with the laws of the State of Israel.
